In the Matter of Trust Created by Will of Frank M. DeForceIt is ORDERED and NOTICE IS GIVEN that a Petition to Approve Accounts and Other Relief Pursuant to Minnesota Statutes § 501C.0203, signed by Jaclyn Sinus, Senior Trust Officer, dated March 24, 2026, has been filed with the court. The Petition requests an order for the following relief:
(1) Setting a time, place, and hearing on this Petition.
(2) Approving, settling, and allowing the accounts of the Trustees for the period from January 1, 2021, through December 31, 2025.
(3) Instructing the Trustee as to the continued holding and retention of the stocks and bonds aforesaid, including mutual fund holdings.
(4) Authorizing the Trustee to invest trust assets in Nuveen Investments, Inc., a mutual fund for which the Trustee is the investment advisor.
(5) Permitting the Trustee to distribute to the trust beneficiary, Amhurst H. Wilder Foundation, not only all of the net income annually, but also such amount of trust principal so as to avoid the 15% penalty to foundation that do not meet the 5% distribution requirement imposed by Section 4942 of the Internal Revenue Code.
(6) Allowing attorney fees and necessary disbursements in connection with the hearing.
(7) For such other and further instructions, orders and relief herein as may be proper.
IT IS ORDERED, that the Petition will be heard remotely on April 20, 2026, at 2:00p.m. by this court. The court will notify the petitioner (or the petitioner's attorney, if applicable) with further information regarding remotely attending this hearing. If you are not the petitioner and wish to appear at the hearing to object, please contact the court by phone at (651) 266-8145 by 4:30 p.m. on April 17, 2026, so that arrangements can be made for you to appear. Additionally, if you object to the relief sought, you must file a written objection with the court administrator by 4:30 p.m. on April 17, 2026. Written objections can be mailed with the applicable filing fee to: Ramsey County District Court, Room 170, 15 W. Kellogg Boulevard, St. Paul , MN 55102, or electronically filed in the electronic filing system.
IT IS ORDERED that notice shall be given by: giving notice to the current trustees and the qualified beneficiaries in the same manner as set forth under Rule 4 of the Rules of Civil Procedure by serving a copy of the order for hearing and the petition at least 15 days prior to the hearing unless waived in writing by the current trustees and the qualified beneficiaries or if a Qualified Beneficiary is a minor or incapacitated notice shall also be given to any representative person in accordance with Minnesota Statutes sections 501C.0301 to 501C.0305, acting on behalf of the Qualified Beneficiary who is known to the petitioner.
